Well, Mukasey said, the President had ordered that on the advice of the Justice Department that it was lawful. So, just as he will not initiate an investigation of waterboarding since the DoJ had given its OK, he will also not investigate whether the warrantless wiretapping was lawful, since it was legal, because the DoJ said it was ("there are views on both sides of that" he acknowledged).” A different variation of the "we said it was ok, so we can't investigate it" plea: we said it was ok, so by definition it's legal. That would be consistent with CoG being in effect.
- 2008-02-07 /S/D/ Mukasey: No, I Will Not Enforce Citations for Contempt of Congress “Just to complete the theme of the day, Michael Mukasey said today that if Congress passed contempt citations against current and former White House officials based on their refusal to respond to subpoenas, the Justice Department would not enforce them, as federal law instructs.” Not only does he refuse to investigate, but he also won't say whether he has "been instructed to enforce or not enforce congressional citations". Is this a sign that CoG plans are in effect? Regardless, impeachment would seem to be an appropriate response to this and his other refusals that same day (to investigate waterboarding and warrantless wiretapping).
